GRAM is legalistic, strictly complies with Brazilian legislation and, therefore, respects your personal data (“Data”), since they are valuable assets that must be preserved. Therefore, we have created this Privacy Policy (“Policy”) that is always being updated to ensure that your data is protected based on the proposal below:

How we can obtain your data and how we can use it.

This Policy applies to all services provided by GRAM (set of companies listed in the section “Which companies are part of GRAM and therefore are the controllers of your Data”, below) through printed content, product delivery, websites, apps, interfaces, portals, Internet products and applications, and other Gram products and services, whether physical or digital, that display and link to this Policy (“Service” or collectively, “Services”). Uses of Data specific to each Service, not provided for herein, will be regulated in the respective terms of use (“Terms of Use”).

What Data we collect about you

For you to enjoy all the benefits of the Services and participate in promotions, online events, sweepstakes, polls, make purchases, access free Services and subscribe to Services, the first step will be to create a GRAM Account or register with us.

• GRAM Account Data

We collect certain Data about you when you create your GRAM Account, in order for you to create a login and password (“GRAM Account”). During the registration process, we request Data such as your full name, email address, date of birth, gender, location, CPF (Taxpayer ID), address, landline and/or cell phone number and, in the case of subscription to Services, billing data (as applicable to the Service).

• Data from other GRAM registrations

We also collect your Data when you register to access our e-commerce, as well as specific Services that do not use the GRAM Account. In these registrations, we usually request the same Data necessary to create a GRAM Account.

• Navigation Data

We also collect your Data when you:

(i) use our Services;

(ii) fill out forms, make comments, participate in promotions, polls, online events, sweepstakes, perform searches and other interactions on our Services; and

(iii) access our Services through your computer, mobile phone, smart TV and/or other access device. Data collected from your access to the Services includes: your approximate location (latitude and longitude); your IP address; your access device information (such as unit identifier, advertising identifier, operating system name and type); information on your internet connection; your browser type and the pages and content you access on our Services.

In addition, when you interact with certain Services, we may request access to your photo gallery, social media photos, your access device’s camera and microphone, as well as your contact list. In such cases, we will always request your prior authorization for the collection of said Data.

• Data obtained from third parties

We collect Data about you from publicly available sources, service providers and partners who provide us with your Data in accordance with applicable law.

• Anonymized data

In addition to processing the Data in accordance with this Policy, we also collect and process your data anonymously, that is, so that you are not personally identified.

How we use your Data

  • To provide you with services:Comply with the terms and conditions of this Policy, the Terms of Use and subscription agreements (as applicable);Facilitate the purchase and delivery of our products through e-commerce;Deliver printed and/or digital content;Process the payment, in case you contract a paid Service;Confirm and complete your Data, according to the relationship established with you;Comply with the requirements of promotions, commercial actions or contests, in the case of promotions, commercial actions or contests carried out by GRAM, or sponsored by other companies, or through partnerships with GRAM, provided that you have agreed to participate in such promotions, commercial actions or contests;Send confirmations and fulfill your requests, in the case of paid Services; andObtain credit history to help detect and prevent cases of fraud.
  •  To communicate with you:Respond when you contact GRAM, according to the relationship established with you;Conduct polls and surveys in order to test, troubleshoot, improve or rate our Services;Communicate about events, promotions and/or announcements conducted by us and/or Related Companies (as defined in the “Who We Share Your Data With” section below) and/or our partners and advertisers on your email account, text message, messaging app, phone call (including telemarketing) and instant notification (push);Inform about changes to our terms, services or policies (including this Policy); andOffer new Services to you, through your e-mail account, by text message, messaging application, telephone call (including telemarketing) and instant notification (push), including those whose contracting you started, but did not finish.
  •  To provide security and protect rights:Provide technical and operational support and ensure the security and functionality of the Services;Prevent illegal, fraudulent or suspicious activities that may cause damage to GRAM or third parties;Prevent technical or security issues;Protect our rights and property, including from intrusion and hacking; andProtect the proprietary rights of others who use our Services.
  • Customize your experience:Select and customize advertisements for you, on or off the Services;Customize the content and advertising we show on our Services;Make inferences about content and topics that may be of interest to you;Identify and recommend content, products and services from GRAM and Related Companies that may be of interest to you; andCreate a profile about yourself, customizing your experience on our Services and on the services of Related Companies.
  •  To improve, analyze the services and develop new products and services:Develop, benchmark, test and improve the Services, as well as new content and services;Carry out research, analysis and innovation activities related to the performance and improvement of our Services, or those of Related Companies, or even those of our partners and sponsors;Support advertisers and partners in rating the effectiveness and reach of ads and also in understanding the profiles of people who access such ads;Monitor activities and use trends;Measure interactions and audience of the Services;Develop machine learning; andRecognize and track your browsing.
  • To comply with our legal and regulatory obligations:Comply with legal, judicial and administrative determinations and letters from competent authorities; andTake or make legal, judicial and administrative measures to defend our rights and the rights of third parties, including in any judicial or administrative proceeding.
    • To promote social well-being:
      • Carry out, support and encourage research, social projects and initiatives related to general social well-being, citizenship, health, education and culture.
  •  To use Data obtained from third parties:
  • Use the Data for the same purposes permitted by law to the third party who shared your data with GRAM, as well as under the terms of this Policy.

How you can manage your Data

GRAM is committed to ensuring that you exercise your rights.

If you want to exercise your rights and ask questions about your Data, access the Privacy Portal for more information, or your GRAM Account, or contact us through the Customer Service Channel.

Your rights can be exercised in the following ways:

  • Access your Data and rectify them when they are incomplete, inaccurate or out of date. For this, we make tools and settings available in your GRAM Account or in other GRAM registrations that you have (as applicable) so that you can access and correct your Data associated with such registrations.
  • If you have any questions, you can also request access and rectification of your Data, as well as confirm the existence of treatment, through the Customer Service Channel.
  • You can request the deletion of your Data by canceling your GRAM Account or other GRAM registrations you have (as applicable) and GRAM will permanently delete your Data within 180 days. After deletion, GRAM may keep your Data only:

(a) for the period necessary for the purposes of judicial, administrative and arbitration proceedings;

(b) to comply with a legal and/or regulatory obligation;

(c) for the regular exercise of rights, such as enforcing GRAM rights based on the applicable subscription agreement and/or Terms of Use:

(d) in anonymized format.

  • You have the right to receive your Data in a simplified format. For this purpose, we provide the option to download the Data linked to the GRAM Account.

How we process data from minors

We know how important the privacy and data protection of minors is.

We do not allow children under 8 to create a GRAM Account or under 18 to purchase paid Services. In these cases, minors must be represented or assisted by legal guardians, as provided by law.

We have also established a parental consent flow so that minors between 8 and 16 years old can create a GRAM Account. This flow consists of requesting authorization from the legal guardian for the minor to create the GRAM Account, which includes optional filling in the CPF of the guardian for purposes of proving majority.

Which GRAM companies are the controllers of your Data

GRAM companies share infrastructure, systems and technology with each other so that you have an integrated, innovative, efficient and secure experience in all Services.

Your Data is controlled by all GRAM companies listed below, which may be updated:

  • FUNDAÇÃO REDE AMAZÔNICA, non-profit entity, registered under CNPJ no. 05.554.944/0001-24, headquartered at Avenida Andre Araujo, nº 1555, Aleixo, Manaus/AM, Zip Code: 69060-000.
  • ESTÚDIO AMAZÔNICO DE RADIODIFUSÃO LTDA., a company headquartered in the city of Manaus, State of Amazonas, at Av. Rodrigo Otavio, 3373, Crespo district, registered with CNPJ under no. 05.444.807/0001-37.

Who we share your Data with

GRAM uses trusted third-party services and technologies that adhere to acceptable security standards and are subject to confidentiality obligations. Your Data will be shared with the categories of third parties (below) (together, “Partners”) always in accordance with this Policy, the Terms of Use of the respective Service (if any), the applicable legislation and for the purposes established below.

Sponsors and Advertisers.

For purposes of complying with requirements of commercial actions, promotions or contests, in the case of commercial actions, promotions or contests sponsored by other companies or through partnerships with GRAM, provided that you have agreed to participate in such actions or promotions and contests.

Search companies.

In order to provide you with a service that is more suited to your profile, we and/or our research partners will contact you to conduct polls and surveys in order to test, troubleshoot or rate our Services.

Related Companies.

To (i) identify Related Companies’ products and services that may be of interest to you; (ii) create a more personalized profile about you for the purpose of helping to personalize your experience on Related Companies’ services; (iii) offer you interest-based advertising; (iv) perform research and analysis to assist in improving the Related Companies’ services (for example, recommending programs that may be of interest to you); and (v) communicate commercial actions, promotions or contests conducted by Related Companies and/or by GRAM in partnership with Related Companies.

Related Companies are all companies that are or will be controlled, controlling, affiliated or under common control of GRAM.

Information Technology Service Providers.

To (i) provide cloud services for our platform; (ii) host the Services and content; and (iii) provide technical and operational support for the Services. In these circumstances, your Data will be stored and processed on third-party platforms, which may be located in Brazil or abroad.

Technical Support Service Provider.

For third parties who provide technical support services to us to provide assistance to users or subscribers. In these cases, your Data will be processed by such third parties.

Marketing Service Provider.

We rely on third party services to offer advertising relevant to your profile, email marketing, telemarketing, SMS, instant notification (push).

Financial Institutions, Payment Means Providers, Payment Means Integrators and Credit Card Companies.

In order to process the payment in case you contract a paid Service, we will share your credit card number, bank details, billing data and contact information with financial institutions, payment method providers, payment method integrators and credit card companies.

Data and Credit Analysis Partners.

In order to confirm and complete your Data, we will cross-reference the Data you provide us with those you have shared with Data analysis companies, including credit ones.

Government Authorities.

To (i) comply with legal, judicial and administrative determinations and also comply with the offices of competent authorities and (ii) take or cause legal, judicial and administrative measures to defend our rights provided for in this Policy and in the Terms of Use, including in any judicial or administrative proceeding. Government Authorities are law enforcement authorities, public entities and/or other governmental organizations.

Security and fraud prevention entities.

To (i) fulfill a contractual obligation; (ii) exercise the terms and conditions of this Policy and/or the Terms of Use and/or subscription agreements that you have accepted; (iii) prevent illegal, fraudulent or suspicious activities; (iv) prevent technical or security issues; and (v) report violations and/or protect our rights and property.

Measurement Partners.

To perform audience, reach and relevance analysis and measurement reporting of the Services.

GRAM Affiliates

So that they can manage their services that use our technological tools.

Partners and buyers of new companies and/or assets. For the sale of businesses, assets or equity interests in GRAM, or the formation of new companies and investments.

Business Partners.

To (i) improve our Services; (ii) expand our businesses; and (iii) develop new businesses, including businesses involving the provision of data complementing services to third parties, in order to facilitate your registration and improve your experience in the partners’ products and services.

What are cookies and what are their uses

Cookies are small text files sent and stored on your computer. These small files are used to recognize, monitor and store your navigation as a user on the Internet.

What is the use of cookies

The use of cookies to monitor and store information will enable GRAM to offer a more personalized service, according to the characteristics and interests of its users, including enabling the offer of specific content and advertising for each person, benefiting the user’s experience on the Internet.

In general, cookies are used to:

  • Provide differentiated services, remembering who you are and what your browsing habits are, in addition to accessing your GRAM registration information;
  • Calculate GRAM audience size;
  • Monitor the progress of promotions. When a promotion organized by GRAM uses cookies, the information recorded in the cookie indicates the user’s score;

Data collected by Partners on our properties.

We have Partners who include tags, pixels, cookies and other tracking tools on our properties. These technologies allow to track your activities on our properties (including measuring activities and trends in the use of the Services), to offer you the best experience using our Services or targeted advertising with adequate exposure frequency, always seeking to provide you with a unique and personalized experience.

Data collected by third parties on their own properties.

We have several partners, advertisers and/or sponsors who create and offer you goods and services, as well as sweepstakes, commercial actions and promotions through their own properties that are accessed from the Services. The Data you provide when you visit and/or complete transactions on these third-party websites is requested and obtained by these partners, advertisers and/or sponsors, and is therefore subject to their own Data processing practices.

Where we store, process and transfer your Data

You consent that your Data may be transferred, stored and processed in Brazil or abroad by GRAM or by Partners, in accordance with this Policy. Wherever your Data is transferred, stored or processed by us or our Partners, please know that we will take technical and organizational security and confidentiality measures and safeguards to ensure an adequate level of Data protection (see section “How we maintain security of your Data” below).

How we maintain the security of your Data

GRAM implements security controls to protect your Data. We adopt practices in line with technical and regulatory market standards for data security and privacy, with actions in technology and organizational processes.

Our measures to preserve your Data from unauthorized access, use, change, disclosure or destruction include the physical and logical protection of assets, encrypted communications, access management, adherence to secure software development and internal compliance policies that incorporate security in the lifecycle of our Services.
